Budgie (ABN: ABN 69 622 996 795) is an independent Designer located in Sydney, NSW and specialises in design and copywriting for both print and web as well as providing quotes for affordable printing of products.
Please take time to read and ensure you fully understand the terms and conditions before you commence any service with Budgie. Budgie has the right to change or alter these terms and conditions at any time without notice. Please speak with me if you are unsure or do not understand anything in this document.
Privacy Policy:
Any information given to Budgie will be used solely for its own marketing, portfolio and promotion purposes. It will not be sold to any third party.
Payment Terms:
50% payment for the project needs to be paid by Client and received by Budgie before project will be started. If you are having trouble paying your account please advise Budgie as arrangements can be made so no extra fees are applied to your account. Full payment must be paid before high resolution/working files are provided to the Client
Should there be a change or a new concept that differs from the initial brief, additional fees will be payable according to time/materials involved. A new quote or invoice will be provided for review and prompt payment.
All quotes and invoices will be emailed to the client as a PDF file and a link to Budgie’s online accounting software for prompt invoice payments.
When paying your invoice by direct deposit, please send an email to info@budgie.com.au to confirm that the payment has been deposited into our account, and an attached proof of payment receipt from Client’s bank. Please note that Budgie’s account details are located on your invoice as well.
Budgie’s Rights:
Budgie reserves the right to:
1. not to do business with any customer deemed to be a risk for bad debts.
2. refuse any work which is deemed to be illegal or offensive in any part.
3. cancel its services to any customer at any time.
Quotations:
Prices are subject to change without prior notice. Quotes are valid for a period of 7 days after date of quote, subject to sighting of material. Afterwards they are subject to any increases in charges/fees or print costs. Additional changes or departure from the brief will be charged at the normal production hourly rate.
Job Approval:
All care is taken in producing art and it is checked thoroughly to the best of my ability. But it is the sole responsibility of the Client to proofread and check their work during all stages of development and to notify Budgie immediately in writing by return email of any corrections, alterations or proposed amendments. All artwork must be signed off as approved before going to print. While Budgie takes care to avoid errors, once artwork is approved that is final. Take time and care in proofreading and editing your artwork. Spelling mistakes and incorrect information are not Budgie’s responsibility.
Approval of artwork:
Please note that email correspondence is considered written confirmation on design signoff, project commencement and approval to proceed on a project and requirements.
Also note that a verbal instruction given by the Client to Budgie to hand the final artwork file off to a printer for printing constitutes acceptance by the Client that they have checked the document carefully for errors and admissions. No refunds or reprints will be given.
Therefore in all instances Budgie will not accept any responsibility for errors or omissions after a Client has given either a written or verbal approval to proceed with producing final artwork files, printing or delivery of final files to a third-party, eg newspaper/magazine for publication, or another printer not sourced by Budgie .
Late Design/Copy Changes:
Whereby the Client requests further modifications or changes after the completed work has been sent off for printing or final artwork files provided the Client agrees to pay additional costs that may arise.
Colour Variations:
Colour variations between proofs and the finished product is quite common. Where practical, only CMYK colour breakdowns are used in the design process of full colour brochures etc. Colours also change when printed on different paper stocks due to the absorption of the inks. Please note that email proof colours are an indication only and may differ slightly from the finished printed article. There may be some colour variations from what you see on screen, to what the final product looks like, and previous orders. This is due to the nature of CMYK printing and bulk-run printing. There will be no reprints at Budgie’s expense.
Artwork Production Time:
Artwork production time will vary for small or medium size jobs, according to the current workload. The current turnaround time for design is 1-2 months depending on the design product. This is from the time of full payment is made and received. The production time for larger projects will need to be discussed with Budgie for a more accurate turnaround time according to current workload.
Deadlines:
Budgie will not be held responsible or delays caused by factors outside our control such as:
1. the time it takes the customer to supply of all appropriate material necessary for the completion of the job.
2. the time it takes for the customer to approve any stage of the work.
Printing & Delivery Time:
Please allow about 10 working days for printing and delivery - or timeline specified in the quote, if printing has been arranged on Client’s behalf from Budgie , though not guaranteed. Budgie is not liable for printing products that are damaged, lost or delayed when in transit.
Copyright:
It is the Client’s responsibility to make sure that copyright is not being infringed at all times. Budgie accepts no responsibility for any wilful misleading information or material provided to Budgie by the Client, which infringes any copyright law.
Cancelling design project:
Should the Client or Budgie cancel the project at any stage after project commencement in writing, the already paid fee will be non-refundable regardless of the amount of work produced by Budgie and will act as a cancellation fee. Cancellation of the project by Budgie will usually result if the Client has failed to comply with these terms and conditions.
Suspension of Service:
Budgie reserves the right to terminate services in any case where the Client fails to perform their obligations under the terms and conditions stated here or alternatively if the Client and Budgie mutually cease working together. The Client will be notified in writing within 7 days of termination or suspension.
Ownership of Finished Artwork:
Budgie retains ownership and copyright over all artwork until the full invoiced amount has been paid and the project has been completed in its entirety as outlined in invoice. In this case, Budgie agrees to supply the Client a copy of the completed print-ready artwork pdfs created and/or used in the production of their printed material, or web-ready files such as png and jpeg files for use on the internet. If the Client requires the original design working files there will be an additional cost to release these files, and a quote or invoice will provided for prompt payment and release.
Portfolio Rights:
The Client also acknowledges the right of Budgie to use their work in any promotional material, whether it be in a Publication, Mailer, Television Commercial or Multimedia document (for transmission via disk or email) for the purposes of promoting Budgie.
Liability:
Budgie’s liability is strictly limited to the value of the work carried out for the customer, and will not be liable for any losses direct or consequential due to errors or late delivery.
